NCPCR Directs FIR Against UP Teacher for Inciting Assault on Muslim Student, Muzaffarnagar, UP

The National Commission for Protection of Child Rights (NCPCR) has taken action against a private school teacher in Muzaffarnagar, Uttar Pradesh, who instructed students to hit a Muslim student. An inquiry has been initiated, and an FIR has been directed by NCPCR, sparking outrage and global concern.

In a concerning incident, the National Commission for Protection of Child Rights (NCPCR) has intervened after a distressing video emerged online. The video showed a private school teacher in Muzaffarnagar, Uttar Pradesh, instructing her students to physically assault a fellow student who is of Muslim faith. In response, the NCPCR has issued a directive to the Senior Superintendent of Police (SSP), Muzaffarnagar, to launch an inquiry and file a First Information Report (FIR) against the said teacher.

The video, which went viral on social media, depicted the teacher instructing each student in her classroom to take turns hitting the Muslim student, who was visibly upset and in tears. This incident, characterized by the teacher’s derogatory comments towards the student’s faith, has prompted widespread outrage and condemnation.

Taking suo motu cognizance of the disturbing video, the NCPCR emphasized that the young student was subjected to both physical and mental harassment within a school located in Muzaffarnagar district. The commission has acted swiftly, instructing the SSP to provide an action taken report within a week.

Moreover, the NCPCR has directed the Muzaffarnagar District Magistrate (DM) to initiate proceedings under Section 17 of the Right to Education Act, 2009. This section pertains to situations involving the physical punishment or mental harassment of a child. The commission further highlighted that both the victimized child and the other students involved should be presented before the Child Welfare Committee for necessary protection and counseling.

Section 75 of the Juvenile Justice (Care and Protection of Children) Act, 2015, is also being invoked in this matter. This section outlines the penalties for individuals associated with an organization entrusted with the care and protection of children, who commit offenses against children. Such offenders can face rigorous imprisonment and hefty fines.

The NCPCR’s intervention includes a request for information from the DM about the school’s recognition status and enrollment numbers. Details about the total number of teachers, their qualifications, and any child rights training conducted in the past five years have also been sought.

The incident transpired at Neha Public School in Khubbapur village, where the teacher, identified as Tripta Tyagi, allegedly ordered students to take turns slapping the Muslim student. The video not only highlights the concerning actions of the teacher but also underscores the need for a robust safeguarding system within educational institutions.

The emergence of this video has sparked widespread anger and calls for accountability, both within India and globally. It serves as a stark reminder of the importance of protecting children’s rights, irrespective of their background, and ensuring a safe and nurturing environment for all students. An FIR has been lodged in response to the outrage generated on social media, marking the initial step toward a thorough investigation into this distressing incident.
